The
Supreme Court of India, in Authority for Advance Rulings (Income-tax) v.
Tiger Global International II Holdings (SLP (Civil) Diary No. 1251 of
2025), passed an interim order staying the operation, implementation, and
execution of the judgment dated 28.08.2024 rendered by the Delhi High Court in
W.P.(C) No. 6765 of 2020, which had interfered with the order passed by the
Authority for Advance Rulings.
The
Special Leave Petition was filed by the Revenue challenging the judgment of the
Delhi High Court. Upon hearing the learned Additional Solicitor General
appearing for the Revenue and the learned senior counsel appearing for the
respondent-assessee, the Supreme Court condoned the delay in filing the
petition and issued notice, returnable on 14.02.2025.
The Court
recorded that the issues raised in the petition require thorough consideration.
In the meantime, the Supreme Court directed that the impugned judgment and
order passed by the High Court shall remain stayed from its operation,
implementation, and execution.
The
matter thus remains pending for final adjudication before the Supreme Court,
and the legal position as determined by the Delhi High Court does not presently
operate.
